By accessing or using GonkaGate (the "Platform") and any services provided through it, you (the "User" or "You") agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you should immediately stop using the Platform.

You must be at least 18 years old and have the legal capacity to enter into binding agreements to use this Platform. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

IMPORTANT NOTICE: The Platform is NOT a regulated financial service, payment institution, e-money issuer, money transmitter, or licensed entity of any kind in any jurisdiction. The Platform is a technology interface that provides API access to decentralized compute infrastructure. Any financial-sounding terms used herein (such as "balance," "payment," "billing," "top-up") are used only as a basic reference for user convenience, without any effective or legal meaning of the same terms in a regulated and/or financial environment.

NOTICE REGARDING OPERATOR: The Platform is operated as a technology interface. By using the Platform, you acknowledge that you are interacting with software infrastructure that provides access to decentralized compute resources. The Platform's operator may establish a formal operating entity in the future as the Platform develops.

2. Service Description

Cryptocurrency payments are processed through designated wallet addresses. The Platform does not have access to your wallet private keys or transaction history beyond what is necessary to credit your account.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE PLATFORM OR ITS OPERATOR BE LIABLE FOR:

GonkaGate, including its brand, website, documentation, and software, is the property of the Platform's operator or its licensors, unless covered by any open-source software license, in which case such license's terms will be followed as appropriate. You may not use any trademarks without permission.

You retain ownership of any content you submit to the Platform (prompts, inputs). You also own the outputs generated in response to your inputs, subject to any applicable AI model licenses.

10.3 AI Models

AI models accessible through the Platform are owned by their respective creators and are subject to their own licenses (e.g., Llama's license, Mistral's license).

10.4 Feedback

All remarks, suggestions, ideas, materials, or other information provided by you through the Platform may be used by the Platform's operator without restriction or compensation to you.

12. Dispute Resolution

12.1 Informal Resolution

Before initiating any formal dispute process, you agree to contact the Platform at support@gonkagate.com and attempt to resolve the dispute informally. The Platform will make best efforts to respond and work in good faith toward a resolution.

12.2 Governing Principles

These Terms shall be interpreted in accordance with generally accepted principles of international commercial law. In the absence of applicable international principles, disputes may be resolved under the laws of the jurisdiction where the disputing party is located.

12.3 Individual Claims Only

You agree to resolve disputes on an individual basis only. You waive any right to participate in a class action, class arbitration, or any other representative proceeding. No arbitrator or court may consolidate more than one person's claims or preside over any form of representative or class proceeding.

Any claim arising from these Terms or use of the Platform must be brought within one (1) year of the event giving rise to the claim.

The Platform does not sell Gonka tokens (GNK) or any other cryptocurrency directly. The GNK token is used internally for settlement with the Gonka Network and is not offered to users. Any digital token used in connection with the Platform is strictly a utility token and is not structured as nor intended to be a security or financial product in any jurisdiction.

By accessing or using the Platform, you expressly acknowledge and assume the following risks:

Digital assets are not issued by any central banks or national, supra-national, or quasi-national organizations. They are not backed by any hard assets or other credit. The value of digital assets is affected by several factors, including but not limited to:

The volatility and unpredictability of the value of digital assets relative to government-issued currency may result in significant loss over a short period of time. No one shall be obliged to guarantee the liquidity or the market price of any digital assets.

The Platform shall have no liability for any delay, error, interruption, or failure to perform any obligation under these Terms where the delay or failure is directly or indirectly resulting from causes beyond reasonable control, including but not limited to acts of God, nature, court or government; failure or interruption in public or private telecommunication networks; delay, failure or interruption in third-party services; strikes, lockouts, labor disputes, wars, terrorist acts, riots; global pandemics and other public health emergencies.

You understand and agree that you use the Platform at your sole, exclusive, and own risk. This section is not exhaustive and does not disclose all risks that may be associated with digital assets and the use of the Platform. You are strongly recommended to carefully consider whether such use is suitable for you in light of your circumstances and financial position.

13.5 Tax Responsibility

Any uncertainties and unpredictable matters in tax legislation with respect to digital assets may expose you to unknown or unforeseeable tax implications, for which the Platform shall have no liability. You shall hold the Platform harmless from any expenses and losses resulting from any unknown or unforeseeable tax implications.

13.6 No Financial or Legal Advice

Nothing on the Platform or in any documentation constitutes:

These Terms, together with the Privacy Policy and any rules contained on the Platform, constitute the sole and entire agreement between you and the Platform regarding its use and supersede any prior or contemporaneous negotiations, discussions, agreements, understandings, representations, and warranties.

15.2 Severability

If any provision of these Terms is found to be invalid, void, unlawful, or unenforceable under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions.

15.3 No Waiver

The failure of one party to require performance of any provision shall not affect that party's right to require performance at any time thereafter. The waiver of one party to seek recovery for the other party's violation of these Terms shall not constitute a waiver of any subsequent breach or violation.

15.4 Assignment

You may not assign or transfer your rights under these Terms without prior written consent. The Platform may assign, transfer, and subcontract its rights and obligations without any notification or consent required.

15.5 No Third-Party Rights

Nothing in these Terms shall be deemed to create any rights in any creditors or other persons not a party hereto, and these Terms shall not be construed in any respect to be a contract for the benefit of any third parties.
