GonkaGate (the "Platform") is a technology interface that provides API access to the Gonka decentralized GPU network through an OpenAI-compatible interface. It is not a financial service, payment institution, e-money issuer, money transmitter, or regulated entity of any kind in any jurisdiction.

The terms "balance," "payment," "billing," "top-up," and other similar financial-sounding terminology found on the Platform website or in any accessible digital application are used only as a basic reference for user convenience, without any effective or legal meaning of the same terms in a regulated and/or financial environment.

Any digital token that can be used, connected, obtained, or that can interact in any way with any component of the Platform is strictly a utility token and is not structured as nor intended to be a security or a financial product, e-money, or digital payment token in any jurisdiction, and is not actively marketed in any specific location or for any specific target audience or user base.

Nature of the Platform

The Platform operates as a technology intermediary that:

• Provides a user-friendly API interface to access decentralized AI compute resources
• Accepts cryptocurrency transfers in exchange for API access credits
• Routes API requests to the decentralized Gonka Network
• Does NOT custody, hold, or manage user funds beyond operational necessities
• Does NOT provide financial services, investment advice, or act as a money transmitter

Decentralized Network

The Gonka Network is a decentralized, permissionless network of independent GPU miners. The Platform:

• Does NOT own, operate, or control the Gonka Network
• Does NOT have contractual relationships with individual miners
• Does NOT guarantee miner availability, response quality, or uptime
• Cannot predict or control network pricing dynamics
• Is NOT responsible for network-level outages or failures

Geographic Restrictions

The Platform cannot be accessed or used by:

• Any individual citizen, resident, or entity located in the United States of America or any U.S. territory
• Any individual or entity located in jurisdictions where use of decentralized networks, cryptocurrency, or AI inference services is prohibited by law
• Any person or entity subject to international sanctions

The Platform reserves the right to limit availability to any person, geographic area, or jurisdiction at any time and without prior notice, including through IP filtering, VPN detection, and similar technical measures.

Cryptocurrency Transactions

When you transfer cryptocurrency to the Platform:

• You are making a voluntary transfer of digital assets
• Transactions are processed on public blockchains and are irreversible
• The Platform does NOT operate as a cryptocurrency exchange
• The Platform does NOT provide custody services for your cryptocurrencies
• The Platform does NOT sell, buy, or trade cryptocurrencies on your behalf

No Warranties

The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for any particular purpose
• Uninterrupted or error-free operation
• Accuracy or reliability of AI model outputs
• Continuous availability of specific models or features
• Security against all possible threats or vulnerabilities

While the Platform strives to achieve a safe and secure digital environment, there are no guarantees of merchantability or fitness for any use.

Limitation of Liability

To the maximum extent permitted by applicable law, the Platform and its operator shall not be liable for any:

• Direct, indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or digital assets
• Damages arising from service interruption or AI model outputs
• Damages arising from cryptocurrency transactions or blockchain network issues
• Damages arising from regulatory changes or enforcement actions
• Your own management or performance of your digital assets (including any reduction in value, even up to total loss)
• Any taxes or duties payable in respect of your digital assets

Regulatory Uncertainty

The regulatory landscape for cryptocurrency, decentralized networks, and AI services varies by jurisdiction and is subject to change. Users are solely responsible for:

• Understanding and complying with applicable laws in their jurisdiction
• Determining the legality of using cryptocurrency-adjacent services
• Any tax obligations arising from their use of the Platform

Nothing on the Platform website or in any documentation constitutes:

• Investment advice
• Financial advice
• Legal advice
• Tax advice
• Any other professional advice

The Platform is not your broker, intermediary, agent, or legal advisor and has no fiduciary relationship or obligation to you in connection with any decisions or activities effected by you using the Platform.

Users should consult qualified professionals for advice specific to their situation.

Third-Party Wallets and Services

You access the Platform by connecting your own self-custodial cryptocurrency wallets. The Platform disclaims any and all liability for any failure, error, fault, or vulnerability of such wallets, including when they interact with the Platform, and including if such issues result in partial or total loss of any digital assets.

The Platform will not be liable in any way and for any reason should the user interact with an unofficial software fork of any kind, or any alternative version of the Platform built by third parties.
